MEPA Notice of Project Change- Cape Wind Energy Project

By virtue of a relocation of the three nautical mile state territorial boundary by the Minerals Management Service (MMS), ten of Cape Wind's proposed turbine locations and one additional mile of the 115 kV submarine cable fell within the newly determined state waters. Cape Wind subsequently relocated the ten proposed turbine sites to locations in federal waters. Following the boundary change and the proponentﾒs relocation of 10 turbine sites, the situation was unchanged: only the 115 kV transmission cable remained jurisdictional, and all other components were sited in federal waters subject to National Environmental Policy Act (NEPA) jurisdiction.
